“NewJeans Hanni Act” Proposed “Everyone Deserves Respect in the Workplace”

On November 26, Representative Jeong Hye-kyung of the Progressive Party held a press conference at the Communications Building of the National Assembly to introduce a partial amendment to the Labor Standards Law aimed at preventing harassment in the workplace. He underlined: “Regardless of income, employment or contractual relationship, no one should be subjected to harassment by superiors or others in the workplace.”

This follows Hanni’s appearance at the National Assembly inspection of the Committee on Environment and Labour, where she raised concerns about harassment in the workplace. However, on November 20, the Ministry of Employment and Labor ruled that, under current laws, Hanni does not qualify as a “worker” and is therefore not protected from workplace harassment.

Rep. Jeong said: “Not only Hanni from NewJeans but countless other people in the workforce are not protected by this law. This is because current law prohibits workplace harassment only in the context of employment relationships.”

He cited examples, saying: “Apartment security guards are often insulted, told to “bark like a dog”, and some have even suffered assaults and harassment, leading to tragic suicides. However, in such particular employment relationships, current workplace harassment prevention laws are ineffective.”

The proposed amendment introduces special provisions for workers and artists. It also includes measures that oblige employers to take action in cases of harassment by third parties and establishes sanctions for those responsible and for employers who do not take adequate measures against harassment in the workplace.
