Judge Shin condemned the actions, affirming: “The flashing lights to people constitute the use of physical strength and are not part of legitimate safety duties. If the goal was to avoid being photographed, the customer could have traveled discreetly, wear a hat or a mask and avoid crowded areas.”
The judge also stressed: “On the other hand, the customer moved openly through the spaces in which the fans had gathered, almost as if they had had a fans’ meeting. The security team then shone lights to the bystanders who did not represent an apparent threat, irritating the eyes with a useless force.”
Despite the criticisms, the Court considered that it was the first offense of the defendants and that they had committed themselves not to repeat these actions, which influenced the sentence.
The case has rekindled the debate on the “culture of overprising” in the Kex, in which excessive security sometimes disturbs the public and damages the image of an artist rather than safeguarding them.
