IST Entertainment exposes new agency THE BOYZ’s alleged lies about trademark rights
Soon after, 10Asia reported that it had obtained the original copy of IST Entertainment’s claims against One Hundred. 10Asia said these demands would make IST Entertainment the profit benefactor even after THE BOYZ leaves the company. IST Entertainment reportedly agreed to allow THE BOYZ to use all 56 trademarks related to the group for free if they signed a contract that included three clauses. This contract would only be valid if all eleven members of THE BOYZ agreed to work together as THE BOYZ, and would be automatically extended every year if they abide by the terms. The contract would be void at any time if they did not comply with the clauses.
The clauses are:
1. Profits from previous albums and content
Even when THE BOYZ leaves the company, there will be profits generated from content released in the past. As profits from old content increasingly skew downward, most entertainment companies pay the group for two years flat, rather than continuing to pay. IST Entertainment suggested that the boys be paid one year instead, as this area was not included in their previous exclusivity contract. Any profits after the year would belong exclusively to IST Entertainment.
2. Ban on remastering and remakes
IST has requested a permanent ban on any acts of monetization and sale of THE BOYZ sound sources and content owned by IST Entertainment. Although some members are credited for songwriting or writing lyrics to some of their songs, IST Entertainment owns the masters. Therefore, the new agency and the members cannot profit from the song unless they remake or remaster it.
3. Sale of shares
IST Entertainment has requested permission to sell its inventory of THE BOYZ products. Usually the goods are sold when the artists terminate the contract. This may impact One Hundred and THE BOYZ as IST Entertainment selling past inventory, possibly at a discounted price, could end up competing with One Hundred’s merchandise. IST Entertainment supposedly has around ten OKs in inventory.
One Hundred has yet to respond to the alleged requests.
