NewJeans and ADOR intervened on the case.
Among the recent news of New Jeans announcing the termination of their contracts and ADOR filing a lawsuit to confirm the validity of the exclusivity contract, Chief Attorney Lee Ji Hoon from LAW AND MORE expressed his opinion on the case.
NewJeans officially announces that it will continue operations without HYBE and ADOR
In his YouTube videosanalyzed the case and revealed his thoughts on the group’s name.
“If they continue operations, they must first change their name. They shouldn’t use that name. NewJeans declares to have legitimately notified ADOR of the contractual termination. Therefore, the copyright, trademark and intellectual property rights in the contract belong to ADOR.
This means they should return the NewJeans name. At the very least, they should be consistent with their claims. If they continue to use the name, liability for damages may arise.
However, this may also mean that they will take back the name through legal action. We also need to see the contract to see whether they can continue operations or not. This way the risk will be lower.”

He also believes that NewJeans’ claims are not sufficient to request termination of the contract.
Considering that there are different interpretations of what behavior interfered with their activities, it is difficult to say that the contract is terminated. If the allegations of interference in their business were the six demands sent by NewJeans, in my opinion, it is difficult to see them as a termination of the contract. Even though they claim the contract has been terminated, I don’t think that’s the case.

He also added that NewJeans says it has no intention of paying penalties. he declared, “But they have to pay. It will be difficult for society to accept that a situation is created where they have to pay and they say they have no intention of paying. Even if they don’t want to give a single penny, they will have to. This is the group’s legal risk.”
Recently, the Korean Entertainment Producers Association criticized the group for leaving a negative impact on the industry.
