The Soul High Court canceled the first sentence relating to the accusations of a report involving Choi Jung-Won.
According to a press release from the lawyer Noh Jong-Oon of the Jonja law firm, legal representative for the party in in the case, the Court of Appeal established on September 19 that the relationship between party A and Choi Jung-Won did not constitute an act of adultery. In addition, the Court established that primary liability for marital breakage resided with the coercive behavior of her husband.
Previously, the Court for the first instance had judged the meetings between the party A and Choi Jung-Won as “adulteral conduct” and believed the party in large part responsible for the failure of the wedding. However, the Court of Appeal reversed this decision.
The appeal sentence said:
“It is difficult to recognize that the party A and Choi Jung-Won have engaged in a conduct that violated marital fidelity to the extent that they constitute” unfaithful acts “pursuant to article 840, paragraph 1 of the civil code or that these acts have caused the dissolution of the marriage. Rather, the marital failure was from the constant behavior of her husband’s husband during the resolution of conflicts.
The lawyer Noh Jong-Oon underlined the impact of the first judgment on the party to:
“Following the judgment of the first instance, the party has undergone a serious social stigma as” adulterous “, suffering immense personal and professional difficulties. His health has deteriorated, making it difficult to continue working and continues to fight serious health problems while taking care of her son”.
He added that since the Supreme Court generally does not re -evaluate the factual results, it is likely that the decision of the high court of Seoul acting as a final judgment.
Noh Jong-Oon also asked the media to correct past relationships suggesting that Choi Jung-Won and the party to had a relationship:
“Our sincere hope is that the media rectify the factual documentation, recognizing that the superior court has not found evidence of adultery and that the reputation and social position of that party to start to be restored.”
