[TRIGGER WARNING: Sexual Assault, Rape]
As the investigation into NCT Taeil’s sexual assault case progresses, K-media has revealed an important detail that may be why SM Entertainment has been adamant in providing updates on the matter.
On October 7, K-media newspaper Chosun Ilbo published an exclusive article stating that the K-pop idol was being investigated on quasi-r*pe charges.
According to the Korean Penal Code, this crime is committed when an armed person or two or more people working together force the victim into a sexual act while he is unconscious or unable to resist.
After being transferred from the Seoul Bangbae Police Station, the case is now being handled by the Seoul Central District Prosecutor’s Office. However, they are yet to summon the celebrity.
Moon was indicted in June on charges of sexually assaulting a drunken woman with two non-famous acquaintances, according to media reports. However, it was only in August that they were summoned for questioning, two months after the incident.
The case is still ongoing, but if Taeil is found guilty, he will serve at least 7 years in prison up to life imprisonment under Article 4(1) of the Law on Special Cases Concerning the Punishment of Sexual Crimes.

As this story developed, netizens and media wondered whether the reason SM Entertainment refused to comment on Taeil’s case was because of this.
When the media tried to ask the label’s position on the matter, SM simply stated:
“It is difficult to comment on the matter because it is currently under investigation.”
