On August 22, the third trial session was held for the cause for damage from 500 million (about $ 360.000 USD) presented by Source Music Against Min Hee-Jin.
Previously, during the second May session, the two sides collided on the legality of the collection of KakaoTalk messages. MIN’s legal team claimed that the messages have been obtained illegally and should not be eligible. In response, the music of origin contrasted that the tests were legally collected, affirming, “Even if the and -mail or messages have been exchanged, if it has been done on company devices, it is not considered private.”
The Court decided in favor of admitting the evidence, explaining, “The problem was if KakaoTalk’s messages could be considered legally admissible. Considering that the KakaoTalk account manager has provided the password in specific circumstances, it is difficult to conclude that the law on the protection of communication secrets violates. Therefore, messages are allowed as evidence.”
As for the procedure, the Court also declared, “A public presentation is not necessary (PT). However, since public processes are the principle, we will proceed with oral topics in an open process.”
The next hearing was scheduled for November 7th.
