On August 29, the criminal division 11 of the court of the western district of Seoul (the chief judge Kim Woo-Hyun) opened the first trial for Mr. A, a 30-year-old man accused of almost rape.
The Signor’s defense lawyer claimed: “Give the remorse and the sincerity of the defendant, the public attention and the media could distort the process”, and asked that the procedure was closed. However, the Court clarified that “the defendant does not have the right to request the closure; pursuant to the law, hearings can be closed to protect the victim’s privacy. The concerns on reputation damage for the accused is not valid reasons”.
However, the bench accepted the charge of the accusation that public auditions could cause further damage to the victim. Public ministries observed: “The main evidence is the CCTV movie from the vehicle, which has graphically recorded the assault. If played in an open court, it could lead to secondary victimization”. The Court then ordered the public closing process.
The judge added that “a verdict cannot be issued in a closed session”, confirming that the conviction hearing will be open.
According to the accusation, Mr. A sexually attacked a 20-year-old woman around 3:30 on June 21 in a parking lot in Seogyo-Dong, Mapo-Gui, Seoul. He was arrested on June 23 after a detention mandate was issued and transferred to public ministries in custody on June 26th.
