On the afternoon of the 29th, Min Hee Jin appeared as a guest on the YouTube channel Kim Young Dae Music School and discussed his feelings about the situation.
That same day, the 50th Civil Division of the Seoul Central District Court rejected Min Hee Jin’s provisional injunction filed on the 13th of last month against HYBE regarding the exercise of voting rights.
Dismissal refers to the procedure in which a case is concluded without judgment when the case does not meet the legal requirements or is not in line with the conditions stipulated by law.
Regarding the decision, the Court explained, “Even if HYBE directs the board of directors to vote in favor of the appointment of Min Hee Jin as CEO, the directors must determine and decide based on their duty of care. It is difficult to view the directors as legally obliged to follow HYBE’s instructions, and since the granting of the injunction would result in no legal effect, the provisional application is ultimately without merit and therefore improper.
Following the ruling, Min Hee Jin appeared on the live broadcast and said: “It wasn’t about whether it was right or wrong, and even winning would have been difficult. There are aspects of the law that seem like puns. I won the first interim injunction to maintain the shareholders’ agreement, but there is this dilemma as to whether HYBE and ADOR are the same entity,” adding: “The reason I filed the injunction was to prove my innocence and integrity. I wanted to push until I had no more options. Contrary to what HYBE claims, I never intended to leave.
Min Hee Jin also expressed: “However, I was curious if it would work. Even the lawyers said there was no precedent and estimated my chances of winning were only 10-20%. From my point of view, it was a way to give HYBE another chance. Since it would be difficult for me to back out, I thought if I could do it this way, maybe my pride would allow me to accept it.
Meanwhile, on the afternoon of the 30th, a board meeting will be held to discuss the reappointment of Min Hee Jin as CEO of ADOR.
