The court agreed with his lawyers.
South Korean president accused Yoon Suk Yeol He was issued by the prison after a Soul court canceled his arrest for technical reasons.
Yoon came out of prison on Saturday 8 March, KST, and was welcomed by his enthusiastic supporters, who exulted as they agitated the flags of South Korea and the United States. Although he has been released, he will still have to face the trial on charges of insurrection.
Yoon was arrested in January after a raid to the presidential palace and accused by ministries for his decree of martial law in December which triggered enormous political turbulence in the country. The National Assembly voted to accuse him, leading him to suspend his office. The Constitutional Court is still deliberating whether to officially reject it.
Yoon spent 52 days in custody before the central district court of Seoul accepted its release request on March 7, KST, citing the need to validate the legality of the investigations against him. Yoon lawyers say that the investigative agency that held him before his formal arrest did not have a legal authority to investigate the insurrection accusations. The Court also declared that the legal period of its formal arrest had expired before being accused.
Yoon Suk Yeol should be tried by the end of the year for trying to impose martial law. If condemned, according to what reported, life in prison or even the death penalty could face.
